部分商品修理更换退货责任规定
Provision of the Repair, Replacement and Return of Some
Commodities.
根据《中华人民共和国产品质量法》、《中华人民共和国消费者权益保护法》及有关规定制定本规定。
This provision is setbased on Product Quality Law of The People's Republic of
China ,Law of the PRC on the Protection of the Rights and Interests of Consumers
and some other provisions.
第十一条:
在三包有效期内,修理两次,仍不能正常使用的产品,凭修理者提供的修理记录和证明,由销售者负责为消费者免费调换同型号同规格的产品或者按本规定第十三条的规定退货,然后依法向生产者、供货者追偿或者按购销合同办理。
Article11:
Where a commodity still cannot be used properly after being repaired twice within the
validity period of three guarantees, by the repair records and certificate repairman
provided, the seller must be responsible to exchange another commodity which is in
the same model and specification or return according to the followed article thirteen,
and then recover the loss from the producer, provider or handle according to
purchaseandsaleagreement.
第十二条:
在三包有效期内,因生产者未供应零配件,自送修之日起超过90日未修好的,修理者应当在修理状况中注明,销售者凭此据免费为消费者调换同型号同规格产品。然后依法向生产者、供货者追偿或者按购销合同办理。
因修理者自身原因使修理期超过30日的,由其免费为消费者调换同型号同规格产品。费用由修理者承担。
Article12:
Within the validity period of three guarantees, if the time is over 90 days since the
commodity was sent to repair and it is still not being mended well because of
producer’s not providing spare parts, the repairman should state in the repairing
condition by which the seller could exchange commodity in the same model and
specification with the former one for the consumer. Then recover the loss from the
producer, provider or handle according to purchaseandsale agreement.
If repair time is over 30 days owing to the repairman’s reason, the repairman should
exchange commodity in the same model and specification with the former one for the
consumer and bear the expenses.
第十三条:
在三包有效期内,符合换货条件的,销售者因无同型号同规格产品,消费者不愿调换其他型号、规格产品而要求退货的,销售者应当予以退货;有同型号同规格产品,消费者不愿调换而要求退货的,销售者应当予以退货,对已使用过的商品按本规定收取折旧费。
Article13:
Within the validity period of three guarantees and it is eligible to exchange for goods,
but if the seller do not have commodity in the same model and specification with the
consumers, and the consumer is not willing to exchange some commodity in other
model and specification, and want to return the commodity, the seller should take it
back. If there is commodity in the same model and specification and the consumer is
not willing to exchange but to return, the seller should take the commodity back and
charge depreciation for the commodity having been used according to this provision.

第四十四条:
经营者提供商品或者服务,造成消费者财产损害的,应当按照消费者的要求,以修理、重作、更换、退货、补足商品数量、退还货款和服务费用或者赔偿损失等方式承担民事责任。消费者与经营者另有约定的,按照约定履行。
Article44:
Business operator that causes damage to the property of a consumer in providing a
commodity or service must assume civil liability by means of repair, redoing,
replacement, return of goods, making up the quantity of a commodity, refund of
payment for the commodity and the service fee or compensation for losses, at the
request of the consumer. Where the consumer and business operator have a separate
agreement, such agreement shall be implemented.
第四十五条:
对国家规定或者经营者与消费者约定包修、包换、包退的商品,经营者应当负责修理、更换或者退货。在保修期内两次修理仍不能正常使用的,经营者应当负责更换或者退货。
对包修、包换、包退的大件商品,消费者要求经营者修理、更换、退货的,经营者应当承担运输等合理费用。
Article45:
For a commodity which the guaranteed repair, replacement and return are specified by
the State or by an agreement between a business operator and a consumer, the
business operator must be responsible for the repair, replacement or return. Where a
commodity still cannot be used properly after being repaired twice within the
guaranteed maintenance period, the business operator must be responsible for
replacement or return.
Where a consumer requires a business operator to repair, replacement or return a large
commodity of which the repair, replacement or return is guaranteed, the business
operator must bear reasonable expenses such as freight.
